In accordance with the provisions in arts. 6.1.a), 7 AND 8 of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data, we inform you that the Data that you provide us will be incorporated and processed in the files owned by the person responsible for the treatment.
Why and for what do we process your data?
At the Fundació Pilar i Joan Miró in Mallorca we treat the information provided by interested persons with the following purposes:
- Manage orders or contract any of our services, either online or in physical stores.
- Manage the sending of the information that they request.
- Develop commercial and / or promotional actions of the person in charge and carry out the maintenance and management of the relationship with the user.
What is the legitimacy for the processing of your data?
The processing of your data may be based on the following legal bases:
- Execution of a contract or in the provision of a service based on a commercial relationship that has the consent of the interested party.
- Legitimate interest to send commercial information about products and services (direct marketing).
- Legitimate interest for the contact and maintenance of the relationship with clients and suppliers.
- Compliance with legal obligations for fraud prevention, communication with public authorities and third-party claims.
- Explicit consent of the user for the elaboration of profiles, contact forms, requests for information or registration in e-newsletters.
- Explicit consent for all detailed treatments.
To which recipients is your data communicated?
In some cases, only when necessary, the Fundació Pilar i Joan Miró a Mallorca will provide user data to third parties. However, the data will never be sold to third parties.
External service providers (for example, payment providers or service companies) with which Fundació Pilar i Joan Miró a Mallorca works may use the data to provide the corresponding services, however, they will not use such information for their own purposes or for assignment to third parties. Filming and/or shooting specific conditions
- This form is applicable to photographic and/or audio visual reports containing information of a general or informative nature about the Fundació and/or its activities, as well as the images or videos provided by the Fundació with the same objectives. This includes publishing in media (traditional or digital) or social media, and its signature automatically implies acceptance of the specific conditions outlined herein.
- The free access images will have the only use of broadcast and promotion in media, but the authors’ rights will always belong to the authors or their agents. This authorization is valid for the publication and/or broadcasting of the obtained material on one occasion only, always including the corresponding credits provided by the Fundació, and it will have to appear clearly and legible in every single publication or use of images or videos and they should not be suppressed, altered or hided in any way.
- This application only covers images of the buildings that make up Fundació Miró Mallorca’s immovable property (indoors and out) and the exhibition rooms of the permanent collection. Under no circumstances does it encompass the use of Joan Miró’s works of art or ones from the Fundació’s temporary collections. To reproduce/distribute filmed material and/or photographs of artwork by Joan Miró, authorization must be sought from Successió Miró, which holds and manages the artist’s intellectual property rights through VEGAP (www.vegap.es) in matters concerning Spanish producers and ADAGP (www.adagp.fr) in the case of foreign ones.
- If total or partial images of work by the artist are photographed or recorded, the express authorization of Successió Miró, C.B shall be required before they can be published and/or broadcast in any form of the media, otherwise this will constitute an infringement of current legislation governing intellectual property rights, leading to possible penalties. To request the authorization of this body, contact Successió Miró’s Copyright Department at rights@successiomiro.com. To film or photograph work by other artists, permission must be requested from the person or body holding or controlling the corresponding copyright.
- Under no circumstances shall Joan Miró’s works of art or the different art materials found in the artist’s studios and new building of the Fundació be handled, taken out of frames, dismantled, separated from their support or cleaned without the Fundació’s written authorization. In the event of damage or loss of any kind or an incident when the report is being made, the Management of the Fundació must immediately be notified, and the person, company or organizing body that applied for permission to make the report or video shall be responsible for all resulting costs.
- The authorized photographic or video team shall always be supervised by staff from the Fundació, normally by a member of the Fundació Miró Mallorca’s Communication & Marketing Department / Collections Department. If this service is required on an extraordinary basis, outside normal opening hours or on public holidays, the body that requested authorization for the photographic report/video shall meet the payment of all expenses derived from this coverage.
- The use of any photographic or video material of Joan Miró’s artwork or art materials or the interiors and exteriors of the buildings that make up Fundació Miró Mallorca’s immovable property for purposes other than those authorized herein is strictly forbidden.
- The Fundació Miró Mallorca shall be given at least 1 copy of the physical and/or digital publication/suport featuring the report on the institution and at least 10 photographs (in case of photo shooting report) and/or at least 1 copy of the edited video recorded at Fundació Miró Mallorca in digital format and/or on a physical support.
- The Fundació shall be provided with the material agreed upon by the parties within a period of no more than 6 months. The Fundació Miró Mallorca may use the said material, whether photographic or video-based, free of charge on any of its own supports (websites, newsletters, on social networks etc.) or on any item subsequently put on sale in Fundació Miró Mallorca’s shop. On signature of this document, the Fundació shall also be authorized to make the material gratuitously available to third parties in order to promote and disseminate the life and work of Joan Miró (leaflets, vinyl decals, signs, press folders, publications, research etc.)
- The material must be delivered to Fundació Miró Mallorca as established herein, either to the attention of the Communication & Marketing Department (roser.salmoral@miromallorca.com / natalia.covas@miromallorca.com) or to the Fundació’s Library & Archives (biblioteca@miromallorca.com) within a period of six months.
- In every publication made in social media the Fundació will be mentioned (@miromallorca) when using images or videos captured in the Fundació or provided by the Fundació. This includes the correspondent credits, user label, user mention in description text, foot note(s) and the correct location of the Fundació.
